PUBLIC OFFER (CONTRACT) for the provision of services and the sale of goods remotely
This Agreement is an official and public proposal (offer) of an individual entrepreneur, hereinafter referred to as the “Seller”, acting through the website tbeacon.com.ua, to conclude a contract for the purchase and sale of Goods remotely with any individual or legal entity, hereinafter referred to as the “Buyer”.
1. GENERAL PROVISIONS
1.1. The contractual relationship between the Seller and the Buyer is formalized in the form of a Public Offer Agreement. Clicking the “Place Order” or “Pay” button by the Buyer means full and unconditional acceptance (acceptance) of the terms of this Agreement in accordance with Art. 642 of the Civil Code of Ukraine.
1.2. The Seller sells Goods (mounted electronic radio detection boards, radio components, designers, housings, components and related accessories), information about which is posted on the Website tbeacon.com.ua.
2. SUBJECT OF THE CONTRACT
2.1. The Seller undertakes to transfer the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods under the terms of this Agreement.
3. ORDERING PROCEDURE
3.1. The Buyer independently places the order through the “Cart” on the website or by calling the phone number specified in the “Contacts” section.
3.2. When registering or placing an order, the Buyer provides:
- Recipient’s full name;
- contact phone number;
- email address;
- delivery address (or delivery service branch number).
4. PRICE AND PAYMENT
4.1. Prices for the Goods are determined by the Seller and indicated on the pages of the site.
4.2. Payment is made:
- by 100% prepayment to the Seller’s bank account;
- through payment systems integrated on the site;
- cash on delivery (subject to prepayment of the delivery cost, if this is provided for by the site rules).
4.3. The costs of payment systems for transferring funds are borne by the Buyer, unless otherwise specified in the description of the Product.
5. DELIVERY AND HANDING OF GOODS
5.1. Delivery is carried out by logistics companies (for example, Nova Poshta) throughout the territory of Ukraine (except for temporarily occupied territories).
5.2. The moment of transfer of ownership is the signing by the Buyer of the consignment note at the carrier’s office.
5.3. Upon receipt, the Buyer is obliged to check the integrity of the packaging and complete set. After leaving the office, claims for mechanical damage are not accepted.
6. WARRANTY AND RETURNS
6.1. На змонтовані електронні плати та радіокомпоненти надається гарантія (термін для перевірки та тестування) тривалістю 1 місяць з дати продажу, за умови відсутності механічних пошкоджень та слідів некоректного підключення джерел живлення.
6.2. Покупець має право повернути Товар (змонтовану електронну плату, радіокомпонент) належної якості протягом 14 днів з моменту покупки, якщо Товар не використовувався, повністю збережено його товарний вигляд, відсутні будь-які сліди підключення, пайки чи монтажу, збережено цілісність захисної (антистатичної) упаковки, пломби, ярлики, а також наявний документ, що підтверджує факт оплати.
6.3. Індивідуальні замовлення: товари з індивідуально-визначеними властивостями (зміна прошивки за запитом, зміна конструкції під конкретну модель), згідно ст. 13 Закону «Про захист прав споживачів», поверненню не підлягають.
7. LIABILITY AND FORCE MAJEURE
7.1. The Parties are exempt from liability for failure to fulfill obligations in the event of force majeure circumstances (military actions, cyberattacks on the server, natural disasters).
7.2. The Seller is not responsible for improper operation of devices in the event of the Buyer’s violation of the operating rules or the use of third-party software.
8. CONFIDENTIALITY
8.1. The buyer consents to the processing of personal data in accordance with the Law of Ukraine “On Personal Data Protection”. The data is used exclusively for order fulfillment and store marketing mailings.
9. SERVICE AND WARRANTY SERVICE
9.1. Warranty service is provided by the Seller throughout the entire established warranty period, provided that the Buyer complies with the operating rules set forth in the instructions for the Goods.
9.2. Delivery of the defective Goods for diagnostics or repair is carried out by the Buyer and at his expense (unless otherwise agreed by the Parties).
9.3. The Seller has the right to refuse warranty repair if:
- the product shows signs of mechanical damage, exposure to moisture or aggressive environments (unless this is provided for by the product’s protection class);
- traces of unauthorized interference with the electronic circuit or independent replacement of components (battery, antenna, etc.) were detected;
- damaged warranty seals or manufacturer identification stickers.
10. SOFTWARE UPDATE (FIRMWORK)
10.1. The Buyer has the right to independently update the software (firmware) of the Product, provided that the official software provided on the website tbeacon.com.ua or the official developer’s resource is used.
10.2. Update risks: the Buyer is aware that the firmware update process is a responsible technical manipulation. The Seller is not responsible for the device’s performance if the damage occurred as a result of:
- power failure of the device or computer during the firmware process;
- using unofficial, modified, or incompatible software;
- using faulty cables or adapters for connection.
10.3. The restoration of a device that has become inoperable due to an unsuccessful independent update by the Buyer is considered a non-warranty event and is paid for by the Buyer according to the service center tariffs.
